Who runs this website?

This website is owned and operated by Lynda Slavinskis trading as All The Doo Dah Day (ABN 26 399 323 932)(“us”). The website is hosted by WIX.com, a third party. 

 

What do these terms and conditions apply to?

These Terms set out the terms and conditions under which the user (“you”) may use our website and services offered by us. This website offers visitors information on our programs and events as well as access to pre-recorded videos. By accessing or using the website, you approve that you have read, understood, and agree to be bound by these Terms.

 

Who can use our website and who can become a site member? 

In order to use our website, sign up as a site member and/or receive our services, you must be at least 18 years of age and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. Children may only access this website under the strict supervision of their parent or guardian.

 

What are the key commercial terms offered to customers?

a) From time to time we may offer event ticketing or subscriptions via the website which events or subscriptions will be governed by their own terms and conditions, however, in general when buying an item, you agree that: 

 

(i) you are responsible for reading the full item listing before making a commitment to buy it; 

(ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

b) The prices we charge for our products and services are listed on the website. We reserve the right to change our prices for products and services displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and GST is available on the payments page.
 

What is your return and refund policy?

We offer no refunds or exchanges on any programs or events. In the case of products that may be sold on this website in the future, we will offer a refund by way of crediting the account the payment was made from, if the product is not fit for purpose under any applicable Consumer Law. If a product is faulty or not fit for purpose you must return it in its original packaging together with your receipt to us within 14 days of receipt of the product. You are responsible for postage costs associated with the return and we are responsible for any postage costs of sending you a replacement product.

 

Can we change what is offered on this website?

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

 

Who owns the intellectual property, copyrights and logos?

All of the information on this website and our services, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related to them, are the exclusive property of Lynda Slavinskis trading as All The Doo Dah Day. Except as provided here, nothing in these Terms shall be deemed to create a license in any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works of anything appearing on this website.

 

What if the user sends in photos or upload anything to the website?

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed on the website, on our social media pages and in our promotional material.

 

Can we suspend or cancel your user account?

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

 

Indemnity

You agree to indemnify and hold Lynda Slavinskis trading as All The Doo Dah Day harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

Limitation of liability

a)To the maximum extent permitted by applicable law, in no event shall Lynda Slavinskis trading as All The Doo Dah Day be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service. We are not responsible for the actions of the host of the website including the inability to access the website due to the third party’s servers not operating.


b)To the maximum extent permitted by applicable law, Lynda Slavinskis trading as All The Doo Dah Day assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

 

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these terms from time to time. When we change the Terms in a material manner, we will let you know. Your continued use of the website or our services after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these Terms or any future version of the Terms, do not use or access (or continue to access) the website or the services.

 

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time by using the “unsubscribe” button on the bottom of any email correspondence or by sending us an email. 

 

Preference of law and dispute resolution

These Terms and the rights and remedies provided in the Terms, and any and all claims and disputes related to the Terms and/or to the services we provide, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the laws of of the State of Victoria, Australia. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in State of Victoria. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

All The Doo Dah Day Privacy Policy

 

Personal Information

 

‘Personal information’ is personally identifiable information such as users’(“you/your”); name, residential and email address, phone number and includes information about subscriptions, credit information and billing records, service and recorded complaints/claims. Lynda Slavinskis trading as All The Doo Dah Day (“we”) will not sell, lease or trade your personal information to third parties.

Publicly available information, such as a public directory listing of name, address and telephone number is not considered personal information. Personal information is collected by All The Doo Dah Day only when you specifically and knowingly choose to provide it, such as when you subscribe to our newsletter, our videos, courses or any publication. We do not collect sensitive information such as race, religion, beliefs or sexual preference.

 

Information gathered via the Internet

 

In general, you can visit the All The Doo Dah Day website without telling us who you are and without giving us any personal information about yourself. There are times, however, when we or our suppliers may need information from you, for example when you sign up as a site member to access our Lynda@Home videos or the Educator Resource Centre or when you purchase a ticket to one of our events or buy products from us. You may choose to give us personal information in a variety of situations. For example, you may want to give us information, such as your name and address or e-mail, to correspond with you, to process an order, or to provide a membership or subscription.

Please note that All The Doo Dah Day does not collect credit card details from the Internet. When purchasing Early Childhood Australia products you will be re-directed to a secure website (STRIPE) where you will be asked to enter your credit card details. All The Doo Dah Day does not store any credit card information on our Internet servers.

 

What we do with your information

 

We will endeavour to let you know how we will use any information collected from you before we collect it. We will ask you if we can use the information to contact you for any reason other than for the purpose for which you provided the information. For example, you may email us with a request for information. We will ask you if we can contact you beyond supplying the information you requested.

 

All The Doo Dah Day collects and uses personal information primarily for the purposes of:

a) providing customers with the products and services they have requested, including delivery of news and related content through print and online; and

b) disseminating appropriate and relevant information about our programs and events. 

 

Personal information is used to communicate with customers about their account and to provide them with information related to other All The Doo Dah Day publications, products and services. We will not sell, lease or trade your personal information to other third parties.

Technical details

 

We use 128-bit encryption when recording personal information, to help us to keep your information secure and to maintain its quality. When you visit this website, our Internet Service Provider (ISP) makes a record of your visit and logs the following information for statistical purposes only:

 

  • User’s server address

  • User’s top level domain name (eg .com, .gov, .au, .uk, etc)

  • Date and time of visit to the site

  • Pages accessed and documents downloaded

  • Type of browser used.

 

No attempt will be made to identify users or their browsing activities except in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect the ISP’s logs.

 

Online community standard guideline

 

All The Doo Dah Day encourages the public to engage with us across a variety of third-party social media platforms. We want our followers to comment, and share their opinions and ideas, but we also aim to maintain a respectful environment, free of harassment.

 

We reserve the right to edit and/or remove contributions in accordance to the following guidelines, if we consider that the content:

 

Is defamatory, abusive, threatening, offensive, obscene, racist, homophobic, sexist or otherwise objectionable

Is false or misleading

Violates any laws including laws regarding harassment, discrimination, racial vilification, privacy or contempt

Infringes intellectual property rights

Is spam, or promotes commercial products or services.

We may also block accounts which breach the guidelines. In addition to observing these guidelines, users must also consider the terms and conditions specified by third-party platforms such as Facebook, Instagram, LinkedIn, YouTube, etc.

 

We endeavour to answer questions submitted through our social media platforms within 24-48 hours, taking into account our business hours are 9.00am to 5.00pm AEST Monday through Friday.
